2. Service Description
Stackout provides a real-time bridge that transfers subscriber data from Substack to Beehiiv.
- We do not guarantee compatibility with all versions of Substack or Beehiiv.
- We may update, modify, or discontinue parts of the Service without prior notice.
- We are not affiliated with Substack or Beehiiv.
3. User Responsibilities
- You are solely responsible for your Substack and Beehiiv accounts, including maintaining access credentials and permissions.
- You represent and warrant that you have the rights and permissions to transfer subscriber data between platforms.
- You must not use Stackout for unlawful purposes, spamming, or transferring data without required consent.
4. Data & Privacy
Stackout processes subscriber data solely for the purpose of enabling near-real-time transfer between Substack and Beehiiv.
- We do not sell, rent, or share your subscriber lists with third parties except as required to provide the Service (e.g., integration with Beehiiv APIs).
- By using the Service, you grant us access and processing rights for the data necessary to perform the transfer and keep the destination list synchronized.

5. Fees & Payments
Stackout is a paid service. Subscription fees, billing cycles, and payment terms will be displayed at the time of purchase.
- Payments are non-refundable unless required by applicable law or otherwise stated at purchase.
- We may modify pricing at any time; changes will apply to future billing cycles and you will be notified as required.
6. Service Availability & Limitations
While we aim for high reliability, Stackout depends on third-party platforms and their APIs.
- We are not responsible for downtime, API changes, rate limits, or restrictions imposed by these platforms.
- You acknowledge that interruptions, delays, or data sync issues may occur, and you agree that we are not liable for losses resulting from such events except as required by law.
7. Intellectual Property
All content, branding, and technology related to Stackout are owned by us or our licensors. You may not copy, modify, distribute, or resell any portion of the Service without our prior written permission.
8. Disclaimer of Warranties
Stackout is provided “as is” and “as available”. We disclaim all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of Stackout.
- Our total aggregate liability for any claim arising out of or relating to these Terms or the Service will not exceed the fees paid by you to Stackout in the three (3) months prior to the claim.

- You may stop using Stackout at any time.
- We reserve the right to suspend or terminate your access immediately if you violate these Terms or engage in activity that harms the Service or other users.
11. Governing Law
These Terms will be governed by and interpreted in accordance with the laws of India, without regard to conflict of law principles.
